When used in this Privacy Statement, the words “we”, “our” and “us” refer to Red Mountain Bank N.A., the terms “you” and “your” refer to our clients and former clients.
For purposes of this statement, the following definitions apply:
- “Non-public personal information” means information about you that we collect in connection with a financial product or service provided to you. Non-public personal information does not include information from public sources, such as telephone directories or governmental records.
- An “affiliate” is a company we own or control, a company that owns or controls us or a company controlled by the same company that owns or controls us.
- A “non-affiliated third party” is a person we do not employ or a company that is not affiliated with us, also known as a non-affiliated third party, or simply, an “other party”.
- “Opt out” means a choice you can make to not permit the sharing of certain information.
We collect non-public personal information about you from the following sources:
- Information we receive from you on applications for the bank’s products or services or other forms;
- Information we receive from your transactions with us, our affiliates, or others;
- Information we receive from a consumer reporting agency.
- Information we receive from you on applications or other forms, such as your name, address, employment, income, assets, liabilities and net worth;
- Information about your transactions with us, our affiliates, or others, such as your account balance, payment history, parties to transactions, transaction volumes, and credit card usage;
- Information we receive from a consumer reporting agency, such as your creditworthiness and credit history.
By sharing your information with our affiliates and other third parties with which we have relationships, you will allow us the ability to better serve your needs. We will be able to assist you by providing a wide variety of financial services and products that will best suit you. We may disclose nonpublic personal information about you to the following types of third parties:
- Financial service providers, such as mortgage bankers, securities broker-dealers, and insurance agents;
- Non-financial companies, such as retailers that have joint marketing agreement with the bank
We may also disclose nonpublic personal information about you to nonaffiliated third parties as permitted by law.
We may disclose all of the information we collect, as described above to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements.
We may disclose information about your transactions to our affiliates to
- Provide you with information about other services and products available to you;
- Evaluate our total relationship with you and our affiliates to ensure we are providing maximum value to you.
If you prefer that we not disclose nonpublic personal information about you to nonaffiliated third parties, you may opt out of those disclosures, that is, you may direct us not to make those disclosures (other than disclosures permitted by law). If you wish to opt out of disclosures to nonaffiliated third parties, you may return the “opt out” election form at the bottom of this statement.
If you prefer that we not disclose information about your transactions to our affiliates so that they can introduce you to new products they offer then you may direct us not to make those disclosures (unless there is already an existing pre-existing business relationship). If you wish to opt out of disclosures to our affiliates, you may return the “opt out” election form at the bottom of this statement.
Your direction to opt out is effective until you revoke it in writing. If your banking relationship is terminated, the opt out direction continues to apply to the nonpublic personal information that we collected during or related to the relationship. If a new relationship is later established, the opt out direction applied to the former relationship does not apply to the new relationship and your wish to opt out again must be re-communicated in writing. Your opt out request will become effective as soon as reasonably practicable after we receive it.
We restrict access to nonpublic personal information about you to those who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.
